The SC opined that until a person applying for execution establishes his title as the transferee of a decree, he cannot claim the benefit of that provision. Such assignment can be in writing or by operation of law. In this behalf section 5 of the TPA defines “transfer of property” as an act by which the transferor conveys property in present or in future to the transferee or transferees.
