When lessee continues in possession upon determination of lease, with lessor not consenting to the same in any way, the status of lessee becomes that of tenant at sufferance and his possession becomes unlawful and akin to that of trespasser, though possession can only be recovered by the lessor in accordance with law. By legal fiction his possession is deemed to be juridical and permissive in nature. Such possession cannot be considered adverse to title of lessor.
